1. Acceptance of Terms
By checking the box indicating your agreement to these Terms of Service ("Terms") and our Privacy Policy, you enter into a binding agreement with Self Systems, Inc. ("Self Systems," "we," "us," or "our"). You must be at least 18 years of age to use our services.
These Terms and the Privacy Policy govern your use of the Temi platform. To receive telehealth services, you must also separately consent to the Telehealth Consent and acknowledge the Medical Privacy Notice issued by Temi Medical Group. Those are separate agreements and notices between you and Temi Medical Group, not Self Systems.
2. Description of Services
Temi is a technology platform operated by Self Systems that connects patients with licensed healthcare providers for telehealth consultations. Self Systems does not provide clinical care and does not practice medicine. Clinical services are provided by licensed physicians through Temi Medical Group (Kevin Brandstetter, M.D., A Professional Corporation), an independently owned professional corporation, and are governed by the Telehealth Consent.
Self Systems may handle health-related information to operate the platform and is contractually required to protect it consistent with applicable confidentiality laws and our notices.
3. Eligibility
You must meet all of the following requirements to use Temi:
- You are at least 18 years of age.
- You are a resident of the United States.
- You are located in a state where Temi's services are currently available.
4. Your Account
You agree to provide accurate, current, and complete information when creating your account and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each person may maintain only one account. You agree to notify us immediately of any unauthorized use of your account.
5. Payment and Refunds
Temi charges a fee of $15.00 per consultation request ("Consultation Fee"). The Consultation Fee is charged at the time you submit your request. This is a cash-pay service; we do not bill insurance.
The Consultation Fee covers the telehealth consultation only. If a prescription is issued, medication costs are separate and paid directly at the pharmacy you select.
Refunds. You may request a full refund of the Consultation Fee for any reason by contacting us at [email protected].
6. Not for Emergencies
Temi is not an emergency medical service. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not use Temi to seek treatment for urgent or emergency medical conditions.
7. Intellectual Property
The Temi platform, including its design, text, graphics, logos, trademarks, software, and other content, is owned by Self Systems or its licensors and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your personal health purposes, subject to these Terms.
You may not copy, modify, distribute, sell, or lease any part of the platform, nor may you reverse-engineer or attempt to extract the source code of any software, except as permitted by law.
8. User Content
You retain ownership of the information you submit through the platform ("User Content"). By submitting User Content, you grant Self Systems a non-exclusive, worldwide, royalty-free license to use, store, process, and transmit your User Content as necessary to provide and improve the service, consistent with the Privacy Policy.
If you provide feedback, suggestions, or ideas about the platform, you grant Self Systems a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
9. Disclaimers
THE TEMI PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" FOR ITS TECHNOLOGY COMPONENTS. SELF SYSTEMS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PLATFORM, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Self Systems does not warrant that: (a) the platform will be uninterrupted or error-free; (b) any particular pharmacy will fill a prescription; (c) any particular medication will be available; or (d) any particular clinical outcome will result from a telehealth consultation. Pharmacy fulfillment, medication availability, and clinical outcomes are the responsibility of the treating physician and applicable pharmacy, not Self Systems.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELF SYSTEMS' TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL CONSULTATION FEES YOU HAVE PAID TO SELF SYSTEMS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THIS LIMITATION OF LIABILITY DOES NOT APPLY TO LIABILITY FOR PROFESSIONAL MEDICAL NEGLIGENCE BY TREATING PHYSICIANS, WHICH IS GOVERNED BY THE TELEHEALTH CONSENT AND APPLICABLE LAW.
IN NO EVENT SHALL SELF SYSTEMS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY.
11. Indemnification
You agree to indemnify, defend, and hold harmless Self Systems and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your violation of these Terms; (b) your misuse of the platform; or (c) any information you provide through the platform that is inaccurate, misleading, or false.
12. Dispute Resolution
Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Binding Arbitration. You and Self Systems agree to resolve any disputes arising out of or relating to these Terms or your use of the platform through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in San Francisco, California, unless you and Self Systems agree otherwise.
Scope. This arbitration provision applies to disputes between you and Self Systems regarding the platform and these Terms (MSO/platform disputes only). Claims arising from professional medical negligence, malpractice, or clinical care are expressly excluded from this arbitration provision and are governed by the Telehealth Consent and applicable law.
Arbitration Fees. Self Systems will pay all arbitration filing fees, administration fees, and arbitrator fees required by the AAA Consumer Arbitration Rules, consistent with California Code of Civil Procedure § 1281.97.
Class Action Waiver. You and Self Systems agree that any arbitration will be conducted on an individual basis only, not as a class, consolidated, or representative action. If a court or arbitrator determines that this class action waiver is unenforceable, the arbitration agreement shall be null and void as to such proceeding.
Opt-Out. You may opt out of this arbitration provision by sending written notice to [email protected] within 30 days of your first acceptance of these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
Small Claims Exception. Either party may bring an individual action in small claims court for disputes within that court's jurisdiction, provided the action remains in small claims court and proceeds on an individual basis.
13. Modifications
We may update these Terms from time to time. If we make material changes, we will provide you with reasonable notice (such as by email or a notice on the platform) before the changes take effect. Your continued use of the platform after the effective date of the revised Terms constitutes your acceptance of the changes. Each version of these Terms will include an updated version number and effective date.
14. Termination
Either you or Self Systems may terminate your account at any time. If you have a pending consultation request at the time of termination, we will either complete the consultation or provide a full refund of the Consultation Fee.
Upon termination, your right to use the platform ceases immediately. Sections that by their nature should survive termination (including Sections 7, 8, 9, 10, 11, 12, and 15) will continue in effect.
15. General Provisions
Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Self Systems regarding the platform. The Telehealth Consent and Medical Privacy Notice are separate agreements and notices between you and Temi Medical Group and are not part of this agreement.
No Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Assignment. Self Systems may assign its rights and obligations under these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.
