Terms of Service

Effective Date: July 26th, 2025

These Terms of Service ("Terms") govern your access to and use of the web and mobile application (the "Product") provided by TEMI by Self Systems, Inc. (the "Company," "we," or "us"). The Company is a Delaware corporation with its principal place of business at 40 Wentworth Pl, UNIT 1, San Francisco, CA 94108. By creating an account or using the Product, you agree to these Terms and our Privacy Policy (incorporated by reference), and you consent to the monitoring, recording, processing, and storage of your interactions with the Product as described herein.

1. Educational Information Service; No Medical Advice

The Product is an educational health information platform that provides algorithmic organization of publicly available medical literature. The Product does not practice medicine, provide medical advice, diagnose conditions, or recommend treatments.

By using the Product, you acknowledge that:

  • All information is educational in nature and derived from public medical literature.
  • No doctor-patient relationship is created through use of this service.
  • You are solely responsible for all healthcare decisions.
  • You must consult qualified healthcare providers for medical advice.

2. Not For Emergencies

The Product is not designed or intended for medical emergencies. If you are experiencing a medical emergency, call 911 or your local emergency services immediately.

3. No Medical Practice

The Company does not practice medicine. The service presents educational health information from published sources without providing medical advice, diagnosis, or treatment recommendations.

Medical malpractice: The Company does not create a doctor-patient relationship and does not practice medicine. As such, the Company cannot be held liable for medical malpractice.

4. User-Driven Experience

The service operates on a user-driven model where:

  • You control what information you choose to input and view.
  • The Product processes your inputs to organize and present educational health information.
  • The Product does not provide medical advice, diagnosis, or treatment recommendations.

5. User Accounts

You may create an account to access the Product. You must:

  • Be at least 18 years old.
  • Provide accurate information.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activities under your account.

We reserve the right to terminate accounts that violate these Terms.

6. Data Collection and Use

We collect:

Account data: identifiers (e.g., name, email), authentication, payment (if applicable).

User Content: prompts, messages, notes, files, images, audio/video, and metadata.

Session Data: logs, session replays, device/browser data, cookies, network data, diagnostic and performance data.

Derived data: analyses, summaries, model outputs, embeddings, and other data generated from or about your use of the Product.

How we use data:

  • To provide, personalize, support, and secure the Product.
  • To persist your sessions and history across logins and devices.
  • To analyze usage, prevent abuse, debug, and ensure quality.
  • To develop, test, and improve features, models, and related services.
  • To communicate with you about the Product.
  • To comply with law and enforce these Terms.

Retention and deletion:

  • We are not responsible for holding data and may delete any data at any time without notice.
  • We retain User Content, Session Data, and Derived data for as long as your account is active or as needed to provide the Product, and thereafter for backup, security, analytics, improvement, and legal/compliance purposes.
  • Upon account deletion, we will delete or de-identify your active profile data within a reasonable period (typically 30 days) and will purge most backups and logs on a rolling schedule (typically within 90–180 days), subject to legal holds and safety obligations.
  • Some Derived data (e.g., de-identified analytics, model improvements not tied to identifiable profiles) may be retained.

7. User Content; License; Feedback

"User Content" includes any data you submit or generate through the Product, including text prompts, messages, notes, files, images, audio, video, session recordings, and associated metadata. You retain ownership of your User Content.

You grant the Company a worldwide, non-exclusive, transferable, sublicensable (to our service providers), royalty-free license to host, store, reproduce, translate, analyze, process, adapt, modify, create derivative works from, and otherwise use your User Content and any derivatives for the following purposes: (a) providing, operating, maintaining, securing, and supporting the Product; (b) improving and developing the Product and related models, features, and services; (c) analytics, debugging, and quality assurance; (d) enforcing these Terms and protecting the rights, property, and safety of users and the public; and (e) complying with law. This license survives termination to the extent necessary for the foregoing purposes and for backup, archival, and audit logs.

If you submit feedback, suggestions, or ideas ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use the Feedback without restriction or compensation.

If you submit information about another person (e.g., as a caregiver), you represent and warrant that you have their consent or another lawful basis to do so.

8. Consent to Monitoring and Session Recording

You consent to the monitoring, logging, and recording of all interactions with the Product, including keystrokes, clicks, scrolls, pages viewed, session replays, device and network identifiers, timestamps, IP address, cookies and similar technologies, error reports, and, where enabled, audio and video (collectively, "Session Data"). If you use voice or video features, you consent to audio/video recording and transcription. We collect Session Data to operate, secure, troubleshoot, analyze, and improve the Product, and to provide persistent user experiences across sessions and devices. Where required by law, we will provide just-in-time notices and obtain additional consent.

9. Accuracy Disclaimer

The Product aggregates information from various sources without verifying accuracy. Information may be outdated, incomplete, or incorrect. The Company makes no representations regarding the accuracy or reliability of any information provided.

10. Privacy

Your use of the Product is subject to our Privacy Policy, which explains our data practices and your choices and is incorporated into these Terms. Where required by law, we will obtain additional consent (e.g., for cookies, analytics, audio/video recording).

11. Disclaimers

The service is provided "as is" without warranties of any kind. We disclaim all warranties, including merchantability and fitness for a particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any damages arising from your use of the service. In no event shall the Company's total liability exceed one dollar ($1.00). This limitation applies to all claims, whether in contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration under the American Arbitration Association rules. These Terms are governed by Delaware law. YOU AND THE COMPANY AGREE TO ARBITRATE ON AN INDIVIDUAL BASIS ONLY AND WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected].

14. Modifications

We reserve the right to modify the service or these Terms at any time. Continued use after changes constitutes acceptance.
